1. Agreement to Terms
These Terms of Use (“Terms”) constitute a legally binding agreement between you and Crew Support LLC, doing business as Crew Support (“Crew Support,” “we,” “us,” or “our”), concerning your access to and use of the Crew Support mobile application, website, and related services (the “App”). By accessing or using the App, you agree to be bound by these Terms. If you do not agree, discontinue use immediately. Supplemental policies may be updated periodically; continued use constitutes acceptance.
2. Definitions
“Aviation Professional” includes pilots, flight attendants, and aviation personnel. “Operator” includes aircraft owners, flight departments, management companies, charter operators, and similar entities. “User” means any person or entity accessing the App.
3. Platform Role; Operational Non-Control
Crew Support is strictly a technology platform facilitating connections. Crew Support does not operate aircraft, supervise flight operations, provide air transportation, or make safety or regulatory decisions. All operational responsibility remains with Users.
4. Platform Matching and Proximity Features
The App may include proprietary matching, filtering, or proximity-based tools, including but not limited to the CrewSync Proximity Network, designed to assist Users in identifying potential connections based on factors such as location, availability, preferences, or other data. Users acknowledge that such tools are automated and informational in nature; Crew Support does not guarantee suitability, safety, availability, or performance of any User suggested or displayed. Inclusion or ranking within any proximity or matching system does not constitute endorsement, certification, or recommendation by Crew Support. All engagement decisions remain solely the responsibility of Users.
5. Independent Contractor Status
Nothing herein creates employment, partnership, agency, or joint venture relationships. Users operate independently and control compensation, schedules, and performance.
6. Intellectual Property Rights
All App content, trademarks, and software are owned or licensed by Crew Support and protected by applicable intellectual property laws. Limited license granted for permitted use only.
7. User Representations
Users warrant accuracy of submitted information, legal eligibility, and compliance with applicable laws and aviation regulations.
8. Aviation-Specific User Obligations
Operators retain full responsibility for operational control, safety management, insurance, regulatory compliance, and crew suitability. Aviation Professionals are responsible for maintaining valid credentials, currency, and legal authority to perform services.
9. Prohibited Activities
Users may not scrape data, bypass security, impersonate others, upload malicious content, or misuse the App in violation of law or these Terms.
10. User Generated Contributions
Users may submit content (“Contributions”) and warrant they possess necessary rights and permissions.
11. Contribution License
Users grant Crew Support a worldwide, royalty-free license to use Contributions to operate and improve the App.
12. Qualification and Verification Limitations
Any verification processes are limited in scope and do not guarantee safety, certification, or suitability. Users must conduct independent due diligence.
13. Transactions Between Users
Crew Support is not a party to agreements between Users unless explicitly stated. Performance obligations remain between Users.
14. Mobile Application License
Limited, revocable license to install and use the mobile application in accordance with these Terms.
15. Privacy Policy
Use of the App is subject to the Crew Support Privacy Policy. Data may be processed in the United States.
16. Term and Termination
Crew Support may suspend or terminate accounts for violations of these Terms or applicable law.
17. Governing Law
These Terms are governed by the laws of the State of Texas.
18. Dispute Resolution
Disputes shall be resolved via binding arbitration in Harris County, Texas under American Arbitration Association rules, subject to limited exceptions.
19. Disclaimer
The App is provided “AS IS.” Crew Support disclaims warranties regarding safety, operational legality, or user performance. Aviation activities involve inherent risk.
20. Limitations of Liability
To the fullest extent permitted by law, Crew Support’s total liability shall not exceed the greater of $500 USD or amounts paid in the previous 12 months.
21. Indemnification
Users agree to defend and indemnify Crew Support against claims arising from use of the App or interactions between Users.
22. User Data and Security
Reasonable safeguards are used, but absolute security cannot be guaranteed.
23. Electronic Communications
Electronic communications and signatures are valid and enforceable.
24. Miscellaneous
These Terms constitute the entire agreement between Users and Crew Support.
